Processing of customer and contract data
We collect, process and use personal customer and contractual data for the purpose of establishing, defining the content of and amending our contractual relationships. We collect, process and use personal data about the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill the user. If you order goods from us, we will pass on your personal data to the transport company entrusted with the delivery and to the payment service provider entrusted with the payment processing. 9. Audio and video conferencing
Data processing
Among other things, we use online conferencing tools to communicate with our customers. The tools we use in detail are listed below. When you communicate with us via video or audio conferencing over the Internet, your personal data is collected and processed by us and the provider of the respective conferencing tool.
In doing so, the conference tools collect any data that you provide/enter to use the tools (email address and/or your phone number). Furthermore, the conferencing tools process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” related to the communication process (metadata).
Furthermore, the provider of the tool processes all technical data required for the handling of online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and connection type.
If content is exchanged, uploaded or otherwise made available within the tool, this is also stored on the servers of the tool providers. Such content specifically includes cloud recordings, chat/instant messages, voicemails uploaded photos and videos, files, whiteboards, and other information shared while using the Service.
Please note that we do not have full control over the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. For further information on data processing by the conference tools, please refer to the privacy statements of the respective tools used, which we have listed below this text.
Purpose and legal basis
The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 lit. b DSGVO). Storage period
The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies. 10. handling of applicant data
We offer you the opportunity to apply for a job with us (e.g. by e-mail). Below we inform you about the scope, purpose and use of your personal data processed as part of the application process. We would like to point out that automated decision-making, including profiling, does not take place.
Scope and purpose of data collection
When you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is § 26 para. 1 BDSG (initiation of an employment relationship) and Art. 6 para. 1 lit. b GDPR (contract initiation).
If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6 1 lit. b DSGVO for the purpose of implementing the employment relationship.
Retention period of the data
If we are unable to make you a job offer, you reject a job offer or withdraw your application, we will store the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. Our legitimate interest lies in particular in providing evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will not be deleted until the purpose for continued storage no longer applies.
Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a DSGVO) or if legal storage obligations prevent deletion.
Recipient of the data
The data transmitted as part of your application is transferred using TLS encryption and stored in a database. This database is operated by Personio GmbH, which offers personnel administration and applicant management software (https://www.personio.de/impressum/). Personio is our processor in this context in accordance with Art. 28 GDPR. The basis for the processing is an order processing contract between us as the controller and Personio.
11. Giving away STELP partnerships
Information for the donor
When you give a STELP partnership as a gift, we collect your name, address, contact and bank details as well as the information that you have given the recipient a partnership.
The legal basis for processing the data is Art. 6 para. 1 lit. b GDPR (contract).
We store the information that you have given the recipient a partnership for 10 years.
The recipient of your data is salesforce.com Germany GmbH, which acts as a processor for us.
Information for the recipient
If the donor gives a STELP partnership as a gift and provides your data, we process your first and last name and the information that you have been given a partnership by the donor for the purpose of providing the partnership and fulfilling our contractual obligations to the donor.
The legal basis for processing the data is Art. 6 para. 1 lit. b GDPR (contract).
We store your first and last name and the information that you have been given a partnership by the donor for 10 years.
The recipient of your data is salesforce.com Germany GmbH, which acts as a processor for us.
12. Donations via the donation form at the STELP Gala
If you donate via our donation form, we collect your title, name, contact and bank details as well as the donation amount for the purpose of debiting and documenting your donation.
If you wish to receive a donation receipt, we will also collect your address details.
If it is a donation from a company, we also collect the company data.
The legal basis for processing the data is Art. 6 para. 1 lit. b GDPR (contract). Insofar as we are obliged to issue a donation receipt, the legal basis for the processing of address data is Art. 6 para. 1 lit. c GDPR (legal obligation).
We process this data for as long as we are legally obliged to do so, at least 10 years.
Donations cannot be made via the donation form without providing your first name, surname and e-mail address.
Recipient of the data:
- Direct debit: our bank for the purpose of direct debit collection
- PayPal: Donations via PayPal are processed via the payment service PayPal (PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg). All payment data is entered directly into the PayPal system and cannot be read or saved by us. To process donations, we transmit your name and donation amount to PayPal if you have opted for this payment method. Without the transmission of your personal data, we cannot process a payment via PayPal, but you can choose another payment method. - Stripe: If you choose a payment method offered via the payment processing platform “Stripe”, payment processing will be carried out via Stripe Payments Europe Ltd, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland, to whom we will pass on the information you provide during the donation process in addition to the information about your donation. Your data will only be passed on for the purpose of processing donations with Stripe Payments Europe Ltd. and only to the extent that it is necessary for this purpose. The following payment methods are integrated via Stripe: Credit card payment, Apple Pay and Google Pay.
- Swetrix Ltd: For the purpose of preventing misuse, we use a captcha from the provider Swetrix Ltd, International House, 38 Thistle Street, Edinburgh, United Kingdom, EH2 1EN. Information on the browser, operating system, country and date of the completed captcha challenge is collected. An IP address is not collected. This data can therefore not be assigned to any natural person.
- Donation management: For donation management, we use service providers with whom we have concluded an agreement on order processing in accordance with Art. 28 GDPR.
